Yesterday Congressman Pence met with President George W. Bush in the Oval Office to discuss the Pence Plan: No Amnesty Immigration Reform.

As Amy Fagan and Stephen Dinan of The Washington Times write in this article, "Mr. Bush met yesterday with Rep. Mike Pence, Indiana Republican, who has proposed his own broad immigration plan that includes a guest-worker program for current illegal aliens and future foreign workers, but only after the Department of Homeland Security certifies that the borders are secure."

"The Pence plan would not preclude allowing illegal aliens to obtain citizenship eventually, but Mr. Pence said the aliens must be required to go home and apply at privately run 'Ellis Island centers' in order to come back as part of a legal worker program. He said many senators fundamentally misunderstand House Republicans' objections to the Senate bill."

'They think path to citizenship is how the House defines amnesty, and I've been trying to convey that amnesty for most House members is if you can get right with the law by paying a fine, that's amnesty,' he said. 'The path to citizenship is just an extension of that amnesty."

"Mr. Pence, the chairman of the influential conservative House Republican Study Committee, said Mr. Bush didn't make any commitments but was 'intrigued' by his plan and asked very specific questions."

"I haven't been questioned like that since the ... ninth grade,"Mr. Pence said.

A young woman was about to finish her first year of college. Like so many others her age, she considered herself to be a very liberal Democrat, and was very much in favor of the redistribution of wealth.

She was deeply ashamed that her father was a rather staunch Republican, a feeling she openly expressed. Based on lectures that she participated in, and the occasional chat with a professor, she felt that her father had for years harbored an evil, selfish desire to keep what he thought should be his.

One day she was challenging her father on his oppositon to higher taxes on the rich and the addition of more government welfare programs. The self-professed objectivity proclaimed by her professors had to be the truth and she indicated so to her father. He responded by asking how she was doing in school. Taken aback, she answered rather haughtily that she had a 4.0 GPA, and let him know that it was tough to maintain, insisting that she was taking a very difficult course load and was constantly studying, which left her no time to go out and party like the other people she knew. She didn't even have time for a boyfriend, and didn't really have many college friends because she spent all her time studying.

Her father listened and then asked, "How is your friend Audrey doing?" She replied, "Audrey is barely getting by. All she takes are easy classes, she never sudies, and she barely has a 2.0 GPA. She is so popular on campus, college for her is a blast. She's always invited to all the parties, and lots of times she doesn't even show up for classes because she's too hung over."

Her wise father asked the daughter, "Why don't you go to the Dean's office and ask him to deduct a 1.0 off your GPA and give it to your freind who only has a 2.0? That way you will both have a 3.0 GPA and certainly that would be fair and equal distribution of GPA."

The daugher, visibly shocked by her father's suggestion, angrily fired back, "That wouldn't be fair! I have worked really hard for my grades! I've invested a lot of time, and a lot of hard work! Audrey has done next to nothing toward her degree. She played while I worked my tail off!"

The father slowly smiled, winked and said gently, "Welcome to the Republican Party!"

Ann Coulter, author and political commentator, drew a standing-room only crowd to the East Ballroom of the Bernhard Center last night for a speech on political views and current events. Coulter was brought to Western Michigan University as a guest of the College Republicans.

When asked about her opinion as to whom she would like see run as the Republican presidential candidate in 2008, Coulter said that she would like to see a smaller name on the ticket.

“The Republican Party seems to like the biggest names, the candidates tend to be governors from enormous states. I love Mike Pence [Congressman from Indiana] and Steve King [Congressman from Iowa],” she said.

Re: The Nomination of Jim Haynes

Dear Senator Graham:

We represent a coalition of organizations that cares deeply about putting constitutionalist judges on the federal courts. We are writing to express our concern about your lack of support for the nomination of William "Jim" Haynes to the U.S. Court of Appeals for the Fourth Circuit, effectively blocking him in committee.

With the recent resignation of Judge J. Michael Luttig, and Terrence Boyle’s seemingly endless confirmation delay – also, rumor has it, with Republican acquiescence – the Fourth Circuit needs principled constitutionalists more than ever. In addition, Judge Widener has notified the President he will retire upon his replacement's confirmation. So, the Haynes nomination affects the lives of two public servants.

But our concerns go beyond the Fourth Circuit. In particular, we believe your opposition to Mr. Haynes in the Judiciary Committee is damaging to the principle that judicial nominees with majority support are entitled to an up or down vote on the Senate floor, and blurs the line between the GOP’s treatment of nominees and the Democrats’ minority-obstructionist tactics. Some have even suggested your non-hold/hold amounts to a "silent filibuster" of Jim Haynes.

Despite the American Bar Association twice giving Haynes its highest rating, his nomination has languished in the Senate for nearly three years. Having already been approved by the Judiciary Committee in 2004, his re-approval should be little more than a formality. Instead, your objection to him has prevented even a vote in committee.

In fact, Brett Kavanaugh's recent confirmation amounts to the only strong constitutionalist confirmed to an appellate court since the confirmations immediately following the Gang of Fourteen deal more than a year ago. This is an odd result, given an enhanced Senate Republican majority.

We understand that you and Senator McCain have concerns about the Bush Administration’s policies on prisoners captured in the War on Terror, and about Mr. Haynes’s role in implementing those policies at the Defense Department. However, Jim Haynes has had the obligation to defend the legal rights of his client, the Defense Department, and to follow the legal advice of the Justice Department.

Jim Haynes did a difficult job at a difficult time and deserves our nation’s thanks for his service. Instead, he has faced years of delay, denigration, and stealth tactics that deny him even the courtesy of understanding the reasons for delay.

As a former Air Force lawyer, you know how misleading it can be to conflate U.S. military and legal policy with the personal opinions and preferences of the attorneys implementing those policies. Such tactics have been used in past by Senate Democrats and their allies to smear President Bush’s nominees, a practice you have rightly criticized. Policy disputes with the administration should not carry over to the Senate's consideration of qualified judicial nominees.

We have fought hard to establish the principle that judicial nominees with majority Senate support are entitled to an up or down vote. While we respect your concerns about Jim Haynes, the bases for those concerns simply do not warrant throwing aside such an important principle.

By all reports, your withholding of support for Haynes is all that stands between him and passage out of the Judiciary Committee. If you wish to send the Bush Administration a message on Jim Haynes, that is your right, but we ask you do so by voting against the nominee on the Senate floor.

For now, we ask that you allow him to proceed through committee to an up or down vote before the entire Senate.

Lindsey Graham: A Tom Daschle Republican

This lead in today's Post story by Chris Cillizza about Sen. Lindsey Graham is priceless:

No longer content with bashing Democrats for their obstruction of President Bush's judicial nominees, a coalition of conservative groups is now turning its attention to a prominent Republican -- Sen. Lindsey O. Graham (S.C.).

The story is great news, though. I've referred to Senator Graham as "the Arlen Specter of the south." In same ways, though, the better comparison is to Tom Daschle. As with Daschle, the voters in Graham's conservative home state probably have little idea of Graham's true ideological stance. Sean Rushton makes this point when he says:

A key reason why Lindsey Graham is Senator Graham is because he ran as opposed to the obstruction of the president's judicial nominees. We hope he'll remember that.

Graham is widely thought (along with Senator McCain) to be obstructing the nomination of Jim Haynes, the general counsel of the defense department. Graham apparently has tight connections with military lawyers who disliked the Pentagon's legal position on detainee interrogations. The Post quotes a spokesman for Graham who expresses concern that Haynes may not have been receptive enough to "advice from the military." However, Haynes was obliged to take his legal advice (if that's what the spokesman is referring to) from the Justice Department and the Office of White House Counsel, and he did so.

If Senator Graham nonetheless feels that Haynes is unfit to serve on the Fourth Circuit by virtue of his legal memos (or for any other reason) that's fine. But let's have the debate and the vote.
